Do you have a monetary claim? You too may be affected by a major change in the regulation of the electronic payment order!
Last week we informed you about the entry of class actions into the Czech legal environment through our article. With the adoption of the Act on Civil Class Proceedings also comes significant changes in the regulation of the electronic payment order (EPR), which may fundamentally affect the debt recovery process and which have remained somewhat in the background of interest not only of the professional public.
As of the beginning of July, there is no limit on the amount of the claimed monetary claim, which means that EPR can now be issued even for claims exceeding CZK 1,000,000.
It is possible to serve an EPR (and a regular payment order as well) by fiction if it is delivered to a data box. Service by fiction significantly simplifies the process in cases where the defendant is inactive and does not choose a data box. This change can in many cases shorten the duration of litigation, which could otherwise be considerably prolonged.
For creditors, this innovation is welcome as it can significantly speed up and simplify the debt recovery process. On the other hand, debtors should now be very careful and check their data boxes regularly to avoid unpleasant surprises in the form of an unexpected loss in court.
